1. Scope of Application
These General Terms and Conditions apply to all orders in the Pet Food Online Shop, available at https://www.tierfutter-shop.at/, in the version valid at the time of the order.

2. Conclusion of the contract in the online shop
The presentation of the products in the pet food online shop does not constitute a binding offer to conclude a purchase contract. Only by clicking the "buy" button do you make a binding offer to conclude a contract. Before doing so, you have the opportunity to review and correct the contents of the virtual shopping cart and your address details. You can also cancel the order process at any time by closing your browser.
After submitting your order in the pet food online shop, you will receive a confirmation email (confirmation of receipt). This does not constitute confirmation of the contract by us. Acceptance of your offer to conclude a contract occurs via a separate email (order confirmation) or by dispatch of the goods. If you do not receive an order confirmation or notification of delivery or no goods within seven days, you are no longer bound by your contractual offer. In this case, any services already provided will be refunded immediately. Your statutory right of withdrawal according to Section 3 remains unaffected. Articles, especially promotional items, are only sold in household quantities and only to end users, not commercial buyers.

3. Cancellation Policy | Right of Cancellation & Consequences of Cancellation

3.1 Right of Cancellation
You have the right to cancel within fourteen days without giving any reason. The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the last partial shipment or the last item.

by means of a clear declaration (by email) of your decision to cancel this contract.
To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.

3.2 Consequences of cancellation

If you cancel this contract, we will refund all payments (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered) promptly and at the latest within fourteen days from the date on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back. You must return or hand over the goods to us or to the supplier indicated on the return label promptly and in any event no later than fourteen days from the date on which you notified us of the cancellation of the contract. This deadline is met if you send the goods before the expiry of the fourteen-day period. You only have to pay for any loss of value of the goods if this loss of value is due to handling that is not necessary to check the quality, properties, and functioning of the goods.

3.3  Exceptions to the Right of Cancellation
The right of cancellation does not apply, among other things, to goods that can spoil quickly or whose expiration date would quickly be exceeded. Furthermore, the right of cancellation does not apply to sealed goods that, for reasons of health protection or hygiene, are not suitable for return.

4. Price Information | Validity
The prices stated in the pet food online shop are in euros and include VAT.

5. Minimum Order Value | Shipping Costs
A minimum order value (goods value) of €12.00 applies to your order in our online shop.

For orders up to €49.00, shipping costs are €5.99. For orders over €49.00, shipping is free.

Please note that "goods value" refers to the price including VAT after deduction of discounts and excluding shipping costs.

6. Return options if you ordered from the pet food online shop
Choose between the following return options:
6.1. Drop off your order directly at the branch of the shipping service provider that delivered your shipment. You can find branches, sales outlets, or packing stations in your area on the respective shipping service provider's website.
6.2. Hand your ready-to-ship package over to a parcel delivery driver of the shipping service provider for the return. Express shipping is available within Vienna.

7. Delivery options
Deliveries are only possible within Austria. We will inform you about the delivery time on the respective product page.

8. Availability
If a particular item is not available, we will inform you immediately of the unavailability before accepting your order. In this case, a contract is not concluded. We will promptly refund any consideration already received.

9. Conclusion of Contract

Even in this case, the presentation of the products in the pet food online shop does not constitute a binding offer to conclude a purchase contract. Only by clicking the "Buy now" button do you submit a binding offer to conclude a contract. Before doing so, you have the opportunity to review the contents of your virtual shopping cart. You can also cancel the order process at any time by closing your browser.
After submitting your order in the pet food online shop, you pay directly according to one of the options listed in Section 10. After we receive your payment, you will receive a confirmation email ("Confirmation of Receipt"). This does not constitute confirmation of the contract by us. Acceptance of your offer to conclude a contract is confirmed by a separate email ("Order Confirmation"), in which you will be informed about the further processing of your order.

9.1 Product Availability
If a product you have ordered is not available at the time of your order, Tierfutter will notify you immediately by email, and you will not receive an order confirmation for these products. In this case, a contract is concluded only for the deliverable products, but not for the non-deliverable products, and any payments you have made in this regard will be refunded within 5 business days. In this case, you can also cancel the entire order for the deliverable products (see "Voluntary Return Guarantee").
If you have not received an order confirmation within seven days, you are no longer bound by your contractual offer. Services already provided will be refunded immediately in this case. Your statutory right of withdrawal under Section 3 remains unaffected.

9.2 Voluntary Return Guarantee
Tierfutter will confirm receipt of the returned products by email and will refund any payments you have made within 5 business days. Upon exercising your voluntary right of withdrawal, the refund will be made using the method you originally used for payment. The statutory right of withdrawal (Section 3) applies independently of this voluntary return guarantee and can be exercised separately under the conditions set out in Section 3.

10. Payment
You can pay by invoice, credit card, or PayPal. We reserve the right to offer only certain payment methods in individual cases. The invoice for your order will be sent to you by email, regardless of the payment method you choose. If no email address is provided, the invoice will be sent to you by post.

10.1 Payment by Card
For payments by credit card, the debit will be made within one week of the order confirmation being sent. You can choose between VISA and MasterCard.

10.2 Payment by PayPal
If you have registered for a customer account (pet food account) with us, you have the option of paying for our services and goods using the Reference Transaction function (also referred to as "Authorize & Collect") of PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: PayPal). Using this payment method requires the granting of a direct debit authorization for the PayPal account you have selected for this purpose, in favor of Fressnapf. Accordingly, by using this function, you authorize us to collect any payments owed by you in the future, either once or recurringly (at regular or irregular intervals), from the selected PayPal account.
To use this payment method, you must be registered with PayPal, authenticate yourself with your login details, and confirm the payment instruction to us once in the "Payment by Merchant Direct Debit" section. For this purpose, you will initially be redirected to a PayPal website during the ordering process in our online shop. By confirming the payment function in question, we are authorized to debit the respective PayPal account immediately. At the same time, PayPal is instructed to make the amounts requested by us available by means of a direct debit procedure in accordance with PayPal's terms of use. As a rule, the PayPal account is debited for processing payments in our favor on the same day. Nevertheless, it cannot be ruled out that we may initially only collect a partial amount and then the entire amount due at a later date.
You have the option of changing your direct debit authorization granted to us in favor of Tierfutter at any time in your PayPal profile under the "Payments by Merchant Direct Debit" section, or of revoking this authorization with future effect.
If you order from us as a guest, the PayPal Reference Transaction function is not available. However, you can still pay with PayPal. This payment via PayPal is convenient and secure. You can easily pay with two clicks. Like every PayPal customer, you also benefit from PayPal Buyer Protection with this option. PayPal is only available as a payment method in the Tierfutter online shop.

10.3 Payment in Advance
Payment in advance is only possible if you order in the online shop. If you pay in advance by bank transfer, we will provide you with the bank details in a separate email. The invoice amount must be transferred to our account within 8 days. After we receive your payment, we will ship your order. If we do not receive your payment within eight days, you will receive an email reminding you to make payment within three days. If we do not receive your payment after these three days, the order will be automatically canceled.

11. Warranty
If delivered items exhibit obvious material or manufacturing defects, including transport damage, please report such defects immediately to us or to the employee of the shipping service provider who delivered the items. Failure to report such defects will not affect your statutory rights. However, you will help us assert our own claims against the freight carrier, transport insurance, or our suppliers.

12. Liability
Unlimited liability: We are liable without limitation for intent and gross negligence, as well as in accordance with the Product Liability Act. For damages resulting from slight negligence, we are liable for damages resulting from injury to life, limb, or health.

13. Warranty
If the damage is caused by minor negligence, we are liable for damages resulting from injury to life, limb, or health. In addition, the following limited liability applies: In the case of slight negligence, we are only liable in the event of a breach of a material contractual obligation, the fulfillment of which is essential for the proper execution of the contract and on whose compliance you may regularly rely (cardinal obligation). Liability for slight negligence is limited to the damages foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.

14. Bildrechte
Sämtliche Rechte an den über den Online-Shop abrufbaren Inhalten, insbesondere Marken- und Urheberrechte, liegen bei uns oder unseren Partnern. Sie sind verpflichtet, dies zu berücksichtigen und verpflichten sich keinerlei Inhalte unseres Online-Shops, gleich welcher Art, über den gewöhnlichen Besuch eines Online-Shops hinaus, zu nutzen. Insbesondere ist die Vervielfältigung, Verbreitung und/oder Veröffentlichung von Inhalten, ohne unsere ausdrückliche schriftliche Zustimmung, nicht gestattet.
 
15. Vertragssprache | Rechtswahl | Betreiber
Die Vertragssprache ist Deutsch. Es gilt österrreichisches Recht unter Ausschluss des UN-Kaufrechts. Die Anwendbarkeit zwingender Normen des Staates, in dem Sie bei Vertragsschluss Ihren gewöhnlichen Aufenthalt haben, bleibt von dieser Rechtswahl unberührt.
